Privacy Policy

At TrakMaps, the protection of your personal information has always been a top priority. TrakMaps' Policy regarding the collection, use and disclosure, if any, of personal information is based on Quebec's Act respecting the protection of personal information in the private sector (as modernized by Law 25) and on the 10 principles covered in Canada's Personal Information Protection and Electronic Documents Act ("PIPEDA"). See the Personal Information We Collect section below for a list of the types of personal information which we collect from you subject to this Policy when you do business with us.

Personal Information We Collect

  • Identification and contact information: name, billing and shipping address, email address and telephone number.
  • Account information: username and password, language preference, order history, product registrations and serial numbers.
  • Payment information: the payment details required to process your order, handled through our secure payment processor.
  • Custom map and service information: the locations, coordinates, areas of interest and files you provide for personalized or custom map products.
  • Communications: messages and information you send us through our contact, callback, inaccuracy-report, newsletter and other forms.
  • Technical information: IP address, browser type and pages visited, collected through cookies and similar technologies (see Tracking Technologies below).

Accountability

  • TrakMaps is responsible for personal information under its control.
  • We have designated a Privacy Officer (Responsable de la protection des renseignements personnels) — Paul Nakhleh — who is accountable for our compliance with this Policy and all applicable privacy laws. His contact information appears at the end of this Policy.
  • All TrakMaps employees are responsible for day-to-day compliance.
  • When we use trusted third parties to act on our behalf by performing such functions as fulfilling orders, delivering packages, processing credit card payments or providing customer service, contractual or other appropriate means are used to ensure compliance by such third parties with this Policy and all applicable privacy laws.
  • Our website may contain links to other websites. We are not responsible or the privacy practices of other web sites. We encourage our users to be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by TrakMaps. Please review the Terms of Use for more information.

Identifying Purposes

  • Unless the purpose is self-evident due to the nature of the transaction in question, TrakMaps will identify the purposes for which personal information is collected at or before the time the information is collected.
  • The proposed purposes will be described in a reasonably understandable manner.
  • An example of a self-evident purpose is requesting the name and address of the person placing an order in order to ensure proper delivery.
  • If you become a Registered User , then you choose what information you put in your profile, including contact and personal information.

Consent

  • We will collect, use or disclose your personal information only with your knowledge and consent, except where required or permitted by law.
  • TrakMaps will not make your consent a requirement to the supply of a product or a service other than required to be able to supply the product or service.
  • Consent can be express or, in some circumstances, implied, and given in writing, by using or not using a check-off box, electronically, orally (in person or by telephone), or by your conduct, such as use of a product or service.
  • For sensitive personal information and for non-necessary cookies and tracking technologies, we obtain your express consent, as required by Quebec law.
  • In determining the type of consent to obtain, TrakMaps will consider all relevant factors, including the sensitivity of the information and your reasonable expectations.
  • You may withdraw your consent at any time, on reasonable notice, subject to legal or contractual restrictions. TrakMaps will inform you of the implications of doing so.

    Children's Privacy

  • Protecting children's privacy is important to us. It is not our intent to collect or solicit personal information from anyone under the age of sixteen. If you are under the age of sixteen, please do not attempt to register or send any information about yourself to us, including your name, address, telephone number, or email address. In the event that we learn that we have collected personal information from an individual under the age of sixteen, we will remove that information as quickly as possible.
  • Parents and legal guardians can withdraw consent to their child's participation and use of their personal information at any time by contacting us at privacy@trakmaps.com.

Limiting Collection

  • The collection of personal information by TrakMaps will be limited to what is necessary for the purposes which it identifies.
  • We will collect personal information by fair and lawful means.

Limiting Use, Disclosure, and Retention

  • Personal information will not be used or disclosed for purposes other than those for which it was collected, except with your consent or as required or permitted by law.
  • It will be retained only as long as necessary for these purposes or as required by law.

Communication Outside Quebec

  • Some of our service providers — such as web hosting, analytics, advertising and marketing platforms — store or process personal information outside Quebec, notably elsewhere in Canada and in the United States.
  • Before communicating personal information outside Quebec, TrakMaps assesses the privacy factors involved, as required by Quebec law, and uses contractual or other means to ensure the information receives adequate protection.

Accuracy

  • We will keep your personal information as accurate, complete and up-to-date as necessary for the purposes for which it is to be used.

Tracking Technologies

  • Our website uses cookies and similar technologies. Necessary cookies keep the site working (shopping cart, session, language, security) and are always active.
  • With your consent, we also use analytics cookies (Google Analytics), which help us understand how the site is used so we can improve it, and marketing cookies (Google Ads, Meta/Facebook, Microsoft Advertising and our marketing and communication tools, such as HubSpot and GetSiteControl), which let us measure our campaigns and show you relevant offers.
  • Analytics and marketing cookies are off by default and are activated only if you accept them in the consent window shown on your first visit.
  • You can change or withdraw your choices at any time using the Cookie settings link at the bottom of every page, or delete cookies through your browser settings.
  • We use the information collected by these services to improve our products & services, to improve our website, make it more user-friendly and monitor that it is performing correctly.

Safeguards

  • TrakMaps will protect personal information by security safeguards appropriate to the sensitivity of the information, including through the use of the following measures: physical (e.g., locked filing cabinets, restricted access, appropriate disposal of personal information), organizational (e.g., security clearances, access only on a "need to know" basis), technological (e.g., passwords, encryption) and training of employees.
  • In the event of a confidentiality incident involving your personal information that presents a risk of serious injury, TrakMaps will notify you and the Commission d'accès à l'information du Québec, as required by law. To report a suspected incident, contact our Privacy Officer (see Contacting Us below).

Openness

  • Information about our policies and practices relating to the management of personal information will be made readily available to individuals.

Individual Access

  • Upon request, TrakMaps will inform you of the existence, use and disclosure of personal information relating to you, and give you access to that information. You have the right to challenge the accuracy and completeness of your information and have it amended as appropriate.
  • You may also ask to receive the computerized personal information we hold about you in a structured, commonly used technological format (data portability).
  • However, in certain circumstances permitted by law, this information will not be disclosed to you.

Data Deletion

  • Upon request, users can contact us at privacy@trakmaps.com to request deletion of their data.
  • You may also ask us to stop disseminating your personal information, or to de-index any hyperlink attached to your name, where dissemination of the information causes you injury or contravenes the law (right to de-indexing).

    TrakMaps will inform individuals who make inquiries or lodge complaints about its inquiry or complaint procedures, as applicable. If a complaint is found to be justified, we will take appropriate measures, including, if necessary, amending our policies and practices.

    If you are not satisfied with our response, you may file a complaint with the Commission d'accès à l'information du Québec or the Office of the Privacy Commissioner of Canada.
